Nitte – not a deemed university : HC

The State High Court which has put a brake to a violation of an existing rule by the Nitte and Yenepoya Deemed Universities in Mangalore, has in a significant ruling directed the two universities to admit 25 per cent of students under government quota. The HC ruling while bringing relief to 32 aggrieved candidates who had been refused admission by the universities saying that they were deemed universities and they were not required to abide by the State Government order on admission of students, has come as a great setback to the managements of the two universities.

A Division Bench of the High Court comprising Justice V Gopala Gowda and Justice Dr K Bhaktavatsala, delivering the judgement said that the two universities which come under the purview of the UGC guidelines, cannot provide 100 per cent admissions to students of their choice and have to reserve 25 per cent of the seats to students under government quota and that this policy be made applicable from the current academic year itself. The court said as admission of students under the government quota had come down this year, the institutions would have to make it up next year.

Twenty five students had moved the High Court challenging the universities denying admission to them, while the students who were appointed under management quota too had moved HC fearing loss of admissions.
Tuesday’s verdict has drawn curtains to a legal battle between the aggrieved students and the university managements.

Nitte not a deemed university !The Court also observed that as per records, the Nitte University was not a deemed university as it was yet to disaffiliate itself from Rajiv Gandhi University of Health Sciences (RGUHS). This being the case, the University claiming itself to be a deemed university is meaningless, the HC Bench observed. The Bench further said that the universities denying admission to students under government quota was a violation of the existing rule and that under the UGC Act, the deemed universities are supposed to accept state government rules on admission.
